Helpful Information on Fee Simple and Leasehold Forms of Property Ownership


Fee Simple vs Leasehold Ownership

Most people only know of one type of real estate ownership; fee simple, also known as freehold. Hawaii and a few other states have another form of ownership known as leasehold. The difference in these two types of land tenure is very different and affects the value of the real estate. It is important to know the difference, especially if you’re buying real estate in a leasehold state.
FEE SIMPLE: Fee simple ownership is probably the most familiar form of ownership to buyers of residential real estate. A fee simple buyer is given title to the property, which includes the land and any improvements to the land in perpetuity. In the case of a condominium the purchaser would own a pro-rata share of the land. Aside from a few exceptions, no one can legally take that real estate from an owner with fee simple title. The fee simple owner has the right to possess, use the land and dispose of the land as he wishes–sell it, give it away, trade it for other things, lease it to others, or pass it to others upon death.
LEASEHOLD: A leasehold interest is created when a fee simple land-owner (Lessor) enters into an agreement or contract called a ground lease with a person or entity (Lessee). A Lessee rents the land from the Lessor for the rights of use and enjoyment of the land much as one buys fee simple rights; however, the leasehold interest differs from the fee simple interest in several important respects. First, the buyer of leasehold real estate does not own the land; they only have a right to use the land for a pre-determined amount of time. Second, if leasehold real estate is transfered to a new owner, use of the land is limited to the remaining years covered by the original lease. At the end of the pre-determined period, the land may legally revert back to the Lessor, and is called reversion. At the end of the lease term many lessors and lessees have agreed on either a new lease or the Lessor may agree to sell the land to the Lessee. In the case of a condominium Depending on the provisions of any surrender clause in the lease, the buildings and other improvements on the land may also revert to the lessor. Finally, the use, maintenance, and alteration of the leased premises are subject to any restrictions contained in the lease.

Hawaii Hotel Room Revenue 12.8% Better Than The Same Period Last Year

The Maui News – Maui’s hotels were two-thirds full in September, not unusual for one of the dullest months of 
the year in the visitor industry, but hotel operators were able to boost their rack rates by more than $15 a night.
That contributed to a sizable increase in the amount of money coming in. So far this year, and despite some 
slackness in arrival numbers, Hawai’i's lodging business is doing better than last year, and much better than it 
was in 2009.
The Hawai’i Hotel Flash Report released by Hospitality Advisors last week said that through nine months of 2011, 
island hotels have reaped room revenue of $2.14 billion. That is 12.8 percent better than in 2010 and 20.9 
percent better than in 2009.
But it was not equal to the $2.41 achieved in the first three quarters of 2006.
For the year-to-date, Maui had the highest average daily rate ($246.52), up 9.3 percent. Occupancy rates are 
up about the same amount in each county so far this year, a somewhat surprising result considering the turmoil 
caused by Japan’s earthquake in March and the continuing uncertainty in general economic terms.
Each county is up around 3 percentage points in occupancy. Maui is up to 71.2 percent from 68.8 percent last 
year.

Happy Canadian Thanksgiving From Our Ohana To Yours


Happy Thanksgiving to all of our Valued Friends, Family and Clients
Why do Canadians and Americans celebrate Thanksgiving on different days?
One reason for Canadian Thanksgiving arriving earlier than its American counterpart is that Canada is geographically further 
north than the United States, causing the Canadian harvest season to arrive earlier than the American harvest season. And 
since Thanksgiving for Canadians is more about giving thanks for the harvest season than the arrival of pilgrims, it makes 
sense to celebrate the holiday in October. So what are the differences between Canadian and American Thanksgiving, other 
than the date? Not much! Both Canadians and Americans celebrate Thanksgiving with parades, family gatherings, pumpkin
pie and a whole lot of turkey! What will you be doing to celebrate Thanksgiving this year?
We’re looking forward to a great dinner with our family visiting from Vancouver and are very grateful for our valued

Casino Night Fundraiser for the J. Walter Cameron Center on Saturday October 15th


Casino Night: Gamble and Win Big for A Cause

Do your fingers itch for the gambling tables and die of Las Vegas? From 5 p.m., on Saturday October 15 at the King Kamehameha Clubhouse, legal gambling tables such as: black jack, roulette, craps, bingo, and poker tables will set the scene for a night of fundraising fun for the J. Walter Cameron Center.
Anyone with an affinity for architecture might want to check out the clubhouse, as it is a design from the renowned American architect, Frank Lloyd Wright. From 5:30 p.m., a no-host cocktail bar and auction will open. Pupus will be served and door prizes and live entertainment will keep the energy up throughout the night.
Tickets are $125 each and will go to a worthy community cause. The Cameron Center is home to 20 of Maui’s profit and non-profit health education, rehabilitation, day care, and human service agencies. This benefit will help the center in their continued provision of meeting spaces for hundreds of Maui’s community groups, clubs, social services and local businesses for nominal fees, throughout the year.

There’s good news in real estate to report as we enter the fall season. In August, sales of existing homes rose 8.5 percent to a seasonally adjusted annual rate of 4.47 million in August. What’s important to note is that this rate is 20.2 percent above the 3.72 million pace of August 2010. Also, U.S. home prices were up for the fourth month in a row, according to the latest Standard & Poor’s/Case-Shiller Home Price Indices.
Existing home sales increased from July to August in all regions:
Northeast – increased 2.7 percent
Midwest – increased 3.8 percent
South – increased 5.4 percent
West – increased 18.3 percent
Ron Phipps, President of the National Association of Realtors, reports that currently we are experiencing the best housing affordability conditions in a generation. Clearly, buyers are enjoying the benefits of today’s market and historically low interest rates.
JUST ASK
Q: I’m hearing about something called a “conforming loan limit” and how it’s changing. Can you tell me more about this?
A: The conforming loan limit determines the maximum size of a mortgage that the U.S. – specifically, the Federal Housing Administration, Fannie Mae and Freddie Mac – will guarantee. Before the housing bust in 2008, the government-insured loan limit was $417,000. This limit still applies across most of the country. But in areas with high home values — 250 counties, in all — the government increased those limits to bolster the confidence of cautious lenders.
Since 2008 the limit in affected counties has been $729,750. But as of October 1, the new limit has been reduced to $625,500. Home buyers in these counties can obtain non-conforming home loans (known as “Jumbo” loans), but the interest rates are typically higher and require a larger down payment. In a nutshell, the lowering of the loan limit can mean fewer loan options for buyers in affected counties.

About.com is also a good source for carving tips and recipes. Did you know, for example, that you can use your Jack O’ Lantern as an air freshener? Just sprinkle some cinnamon, nutmeg or cloves on the bottom of the lid.
Spread out your newspapers, get a carving knife and pumpkin, and get ready to have some fun celebrating fall. Happy carving!

29th Annual St. John's Kula Festival

The 29th Annual St. John’s Kula Festival will be held on Saturday, Sept. 24, from 9 a.m. to 3 p.m. in lovely, cool Kēōkea. This festival is always greatly anticipated by Maui residents and visitors alike as a tradition that can be enjoyed by the whole family.
This year, a new layout will facilitate easier access to all the food, fun, fundraising, entertainment and events, but will still showcase the spectacular views of the valley and coasts and offer everything that everyone has come to expect from this event.
The festival will showcase delicious food, including Portuguese bean soup, waffles with fresh Kula strawberries, a wonderful vegan curry, grilled-on-the-spot hamburgers made from Maui Cattle Company beef, fudge, plate lunches, fresh Chinese chicken salad and more, as well as cold drinks and coffee.
Fresh Kula produce, plants and cut flowers, baked goods, a gift shop with handmade items and an assortment of treasures, beautiful gift baskets, a wide variety of crafters, children’s games, free face painting, a silent auction and live entertainment will be offered all day long.
The festival stage will showcase Uluwehi Guerrero’s choir, Na Leo Lani O Maui; Derick Sebastian; the Hula Honeys; and SideTracks. Entertainment will also include the Future Stars of Maui—Gabrielle Goebbert and Austin Carvalho (together known as “The Flow”), The Mill with Christy, Lilly and Zoe and a surprise or two.
Proceeds from this annual event are usually shared with a variety of local nonprofit organizations each year, which are selected by the church, but this year, the organizers decided to focus on one nonprofit. This year’s beneficiary is Hospice Maui; specifically, to contribute to building a 12-bed hospice unit, Hale Ho‘olu‘olu, a place for comfort, compassion and care.
The vision for Hale Ho‘olu‘olu is more than bricks and mortar, construction and staff jobs—it is to help patients live out their lives more peacefully, with more dignity and with less pain, and to provide comfort for the families whose grief is then lightened. It is the highly skilled compassionate team of Hospice Maui caregivers who assist the patients and their families through this transition. Their ideality is a community pulling together to invest collectively in Hale Ho‘olu‘olu, making a peaceful end-of-life experience a reality for all of Maui. St John’s Episcopal Church has been a community center since its beginning in 1900 and continues by offering its facilities for a number of community organizations, operating a pantry that distributes boxes of food to families in emergency situations, and holding a Fellowship Dinner on the last Friday of every month where all are welcome to come and enjoy a free meal and friendship.

Hawaii's Visitor Industry Job Count Continues To Grow

Expected growth in Hawaii’s visitor industry job count could reach as high as 159,542 in 2011, according 
to a statement released today by the Hawaii Tourism Authority (HTA).

The statement issued by the HTA was a reaction to statements made by President Obama and Governor 
Abercrombie last night regarding the importance of job creation in order for our state and nation to fully 
recover from the economic downturn.

“Hawaii’s visitor industry helped to provide 152,864 jobs in the state in 2010, the largest generator of jobs
 among the major industry sectors. Tourism is also the largest single source of private capital into Hawaii,
 with visitor spending reaching $11.4 billion and contributing to $1.1 billion total tax revenue,” said Mike
 McCartney, president and CEO Hawaii Tourism Authority, in a written statement.

“With new airlift, marketing and destination experience-based programs, we anticipate the number of
 tourism related jobs to grow to 159,542 by the end of 2011. Tourism is a natural export for Hawaii
 and the US and provides a strong foundation for our economy.”

According to US News and World Report’s list of “16 Best Adventure Vacations in the USA, the Hawaiian Islands
ranked at the top with Maui ranking #4, Kauai #3, and Hawaii Island #7. The ranking cites Kauai’s “acres of misty
rainforests, plummeting waterfalls and jagged cliffs overlooking the Pacific Ocean;” Maui’s “plethora of
heart-pounding options from sea kayaking to mule riding;” and Hawaii Island’s “black volcanic deserts,
tumbling waterfalls, lush rainforests and five volcanoes.”

“The US News and World Report’s Best Adventure Vacations ranking naming Kauai, Maui, and Hawaii Island in
the top ten is a great recognition for our state,” said Mike McCartney, president and CEO of the Hawaii Tourism
Authority, in a written statement. “This honor is a testament to the things that make Hawaii special – our people,
place and culture, and the commitment of our visitor industry in providing visitors with a unique experience that
cannot be found anywhere else in the world.”

“The natural beauty of our islands shape the many activities our visitors participate in, from soft adventure to the
 more extreme,” said John Monahan, president and CEO of the Hawaii Visitors and Convention Bureau, in a written
 statement. “We’ve been working hard marketing Hawaii’s rich active adventure experiences and are pleased to
see three Hawaiian Islands in the top 10. We encourage visitors to keep exploring all six unique islands – Kauai,
Oahu, Molokai, Lanai, Maui, and Hawaii Island.”

The Best Adventure Vacation list is a part of the 2011-2012 US News Best Vacations rankings, which are updated
annually. The rankings reflect how strongly a destination is recommended by an independent collection of
published travel writers and by US News Travel website users. In total, more than 100 top destinations were
considered in the current rankings.
